Terms of Service

These terms apply to donorpulse.uk and the DonorPulse product apps (sign-in, CRM, website builder, and hosted donation sites). By creating an account or using the service you agree to them. If you use DonorPulse on behalf of a charity, you confirm you have authority to bind that organisation.
The service is operated by Element Software, trading as DonorPulse. Contact: hello@donorpulse.uk.
The service
DonorPulse provides donor and donation management, a constrained website builder, hosted donation pages, Gift Aid support, and related tools. Features depend on the plan described on Pricing. We may change the product, including plan caps and platform fees, with notice to account owners where a change is material.
Accounts and organisations
- You must provide accurate organisation details and keep sign-in credentials secure.
- Organisation owners are responsible for invites, roles, and how staff use donor data.
- We may suspend an account that we reasonably believe is abusive, unlawful, or a risk to other customers or donors.
Plans, caps, and fees
Paid plans are billed through Stripe. Donation-volume caps and DonorPulse platform fees on Connect charges follow the published tier. Exceeding a cap may block further donation records until you upgrade or the calendar month resets. Platform fees are deducted from Connect destination charges as an application fee.
Unless required by law, subscription fees are non-refundable for the billing period already paid. You can cancel in billing settings; access continues until the end of the paid period.
Donations and charities
Donations collected on a charity's site are taken by that charity via Stripe Connect, not by DonorPulse. The charity is responsible for Gift Aid declarations, refunds, charity-law compliance, and donor communications. DonorPulse is not a fundraising platform that receives funds as principal (except the platform fee described above).
Acceptable use
You must not use DonorPulse to:
- break the law, or process donations you are not authorised to collect;
- upload malware, scrape the service, or attack our infrastructure;
- misrepresent your organisation or impersonate another charity;
- interfere with another organisation's data or tenancy.
Your content and donor data
You retain rights in content you upload and in donor data you store. You grant us a licence to host and process that material solely to provide the service. You warrant that you have a lawful basis to store donor personal data and that your use complies with UK GDPR and PECR.
Intellectual property
DonorPulse software, branding, and marketing content belong to Element Software. You may not copy the product or remove branding except as the builder settings allow on your own sites.
Availability and liability
We aim for a reliable service but do not guarantee uninterrupted availability. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss of donations, data, or goodwill. Our aggregate liability in any 12-month period is limited to the subscription fees you paid us in that period (or £100 if you are on the free plan). Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

Our Privacy Policy and Cookie Policy form part of these terms.
Changes and governing law
We may update these terms by posting a new version on this page. Continued use after the update date constitutes acceptance. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
